MBBS Migration In Maharashtra: DMER releases Provisional Selection, ineligible applicants lists

Mumbai: The Directorate of Medical Education and Research (DMER) Maharashtra has released the Provisional Selection List and  List of NOT ELIGIBLE applicants for transfer from One Recognised Medical College to another Recognised Medical College in the State of Maharashtra (2019 - 2020) Regular & Supplementary Batch.

Provisional Selection List for Transfer of Second Year MBBS Course, 2019-2020: The selected candidate should report to DMER CET CELL office for document verification on or before 06/03/2020(Excl. Holidays). The Selected Candidate should produce original documents mentioned in brochure during verification for transfer of 2nd Year MBBS Course –Regular (May-June 2018) and Supplementary (September-October 2019) Batch.The candidates will be issued transfer letter of 2nd Year MBBS after document verification at DMER CET CELL Office. 

List of NOT ELIGIBLE applicants for transfer from One Recognised Medical College to another Recognised Medical College. (May‐June 2019 Regular Batch and September ‐ October 2019 Supplementary Batch)

REGULATIONS OF MEDICAL COUNCIL OF INDIA ON MIGRATION/TRANSFER OF STUDENTS

(REGULATION ON GRADUATE MEDICAL EDUCATION, 1997- PART III, SECTION (4) OF THE GAZETTE OF INDIA VIDE MEDICAL COUNCIL OF INDIA NOTIFICATION DATED THE 4TH MARCH 1997 AND AMENDED VIDE COUNCIL NOTIFICATION DATED 2.7.2002, 30.09.2003, 16.10.2004, 20.10.2008 & 22.12.2008)

Migration:-

(1) Migration from one medical college to others is not the right of a student. However, migration of students from one medical college to another medical college in India may be considered by the Medical Council of India only in exceptional cases on extreme compassionate grounds*, provided following criteria are fulfilled. Routine migrations on other grounds shall not be allowed.

(2) Both the colleges, i.e. one at which the student is studying at present and one to which migration is sought, is recognized by the Medical Council of India.

(3) The applicant candidate should have passed first professional MBBS examination.

(4) The applicant candidate submits his application for migration, complete in all respects, to all authorities concerned within a period of one month of passing (declaration of results) the first professional Bachelor of Medicine and Bachelor of Surgery (MBBS) examination.

(5) The applicant candidate must submit an affidavit stating that he/she will pursue 18 months of prescribed study before appearing at IInd professional Bachelor of Medicine and Bachelor of Surgery (MBBS) examination at the transferee medical college, which should be duly certified by the Registrar of the concerned University in which he/she is seeking transfer. The transfer will be applicable only after receipt of the affidavit.

Note 1

(i) Migration during the clinical course of study shall not be allowed on any ground.

(ii) All applications for migration shall be referred to the Medical Council of India by college authorities. No institution / University shall allow migrations directly without the approval of the Council.

(iii) Council reserves the right, not to entertain any application which is not under the prescribed compassionate grounds and also to take independent decisions where applicant has been allowed to migrate without referring the same to the Council.

Note 2 : * Compassionate grounds criteria :

(i) Death of a supporting guardian.

(ii) Illness of the candidate causing disability.

(iii) Disturbed conditions as declared by Government in the Medical College area.

The above clause 6 has been substituted in terms of notification published on 20.10.2008 in Gazette of India and the same is as under:-

Migration

(1) Migration of students from one medical college to another medical college in India shall be granted only in exceptional cases to the most deserving among the applicants for good and sufficient reasons and not on routine grounds. The number of students migrating to/from anyone medical college shall be kept to the minimum which shall in any case not exceed the limit of 5% of its sanctioned intake in one academic year. There shall be no migration on any ground from one medical college to another located in the same city.

(2) Migration of students from one College to another is permissible only if both the colleges are recognized by the Central Government under section 11(2) of the Indian Medical Council Act, 1956 and further subject to the condition that it shall not result in increase in the sanctioned intake capacity for the academic year concerned in respect of the receiving medical college.

(3) The applicant candidate shall be eligible to apply for migration-only after qualifying in the first professional MBBS examination. Migration during the clinical course of study shall not be allowed on any ground.

(4) For the purpose of migration, an applicant candidate shall first obtain 'No Objection Certificates' from the college where he is studying for the present, the University to which it is affiliated, the college to which migration is sought and the University to which that college is affiliated to. He shall submit his application for migration within a period of one month of passing (declaration of results) of the first professional MBBS examination along with the said 'No Objection Certificates' to the Director, Medical Education of the State where the College/Institutions including Deemed Universities to which migration is sought is situated or to the Head of the Institution in case migration is sought to a Central Government institution. The Director, Medical Education of the State concerned or the Head of the Central Government institution, as the case may be, shall take a final decision in the matter as to whether or not to allow migration in accordance with the provisions of these Regulations and communicate the same to the applicant student within a period of one month from the date of receipt of the request for migration.

(5) A student who has joined another college on migration shall be eligible to appear in the IInd professional MBBS examination only after attaining the minimum attendance in that college in the subjects, lectures, seminars, etc. required for appearing in the examination prescribed under Regulation 12(1)

Note-1: The State Governments/Universities/Institutions may frame appropriate guidelines for grant of No Objection Certificate or migration, as the case may be, to the students subject to provisions of these regulations.

Note-2: Any request for migration not covered under the provisions of these Regulations shall be referred to the Medical Council of India for consideration on individual merits by the Director (Medical Education) of the State or the Head of Central Government Institution concerned. The decision taken by the Council on such requests shall be final.

Note-3: The College/Institutions shall send intimation to the Medical Council of India about the number of students admitted by them on migration within one month of their joining. It shall be open to the Council to undertake verification of the compliance of the provisions of the regulations governing migration by the Colleges at any point of time.

The above clause 6(1) and 6(4)have been further substituted in terms of notification published on 22.12.2008 in Gazette of India and the same is as under:-

6(1) Migration of students from one medical college to another medical college may be granted on any genuine ground subject to the availability of vacancy in the college where migration is sought and fulfilling the other requirements laid down in the Regulations. Migration would be restricted to 5% of the sanctioned intake of the college during the year. No migration will be permitted on any ground from one medical college to another located within the same city.

6(4)For the purpose of migration an applicant candidate shall first obtain "No Objection Certificate" from the college where he is studying for the present and the university to which that college is affiliated and also from the college to which the migration is sought and the university to it that college is affiliated. He/She shall submit his application for migration within a period of 1 month of passing (Declaration of result of the 1st Professional MBBS examination) along with the above-cited four "No Objection Certificates" to: (a) the Director of Medical Education of the State, if migration is sought from one college to another within the same State or (b) the Medical Council of India, if the migration is sought from one college to another located outside the State.

Guidelines for transfer of student(s) of faculty of Medicine from one recognized medical college to another recognized medical college, within the State of Maharashtra after passing the first MBBS.

1. The transfer of successful candidate from one recognized Medical College to another recognized Medical College in the State, shall be possible, i.e., after the declaration of result of 1st M.B.B.S. professional examination of Regular Batch & Supplementary Batch of MUHS, Examination.

2. The transfer can not be claimed as a matter of right by a student. The student desirous to get transfer after passing the first professional examination should apply in the 'prescribed proforma' to the Director, Medical Education, and Research, Mumbai within 30 days from the date of declaration of the result of the Supplementary Batch of the first professional examination of medical faculty conducted by the Maharashtra University of Health Sciences, Nashik. Migration/transfer would be restricted to 5% of the sanctioned intake or clear vacancy of the college during the year. The limit of 5% of sanctioned intake of a medical college in one year stipulated in the Regulation of Medical Council of India on Migration / Transfer of Students read with the notification dated 20th October 2008 and 22nd December 2008 applies only to the receiving college to which the students are being transferred.

3. The notification seeking application for transfer shall be issued by the office of Director, Medical Education, and Research, Mumbai.

4. The applicant student shall obtain 'No Objection Certificate' (N.O.C.) from the 'relieving' college (Annexure-C) and No Objection Certificate (N.O.C.) from receiving/admitting college (Annexure-D). He/She shall also submit No Objection Certificate (N.O.C.) from Maharashtra University of Health Sciences, Nashik/Deemed University situated in Maharashtra. For Government Medical Colleges under this Directorate ', No Objection Certificate' (Annexure-C & Annexure-D) is not necessary for both receiving and admitting college as the same will be decided by this Directorate.

5. The No Objection Certificate from the relieving college under the signature of its Dean/Principal shall indicate. (Annexure - C)

a) The date of his/her birth as mentioned in the record of relieving college.

b) CET marks and percentage scored by the candidate. (MHCET/AIPMT/NEET)

c) The aggregate marks scored by the candidate along with percentage at 1st M.B.B.S. professional examination (Regular/Supplementary Batch as applicable) and seat number.

d) A number of attempts subjectwise in the MBBS Examination.

6. The No Objection Certificate from the receiving/admitting college under the signature of its Dean/Principal shall indicate the availability of 'clear vacancy' against which the transfer is to be effected. (Annexure - D) While calculating clear vacancy, number of students admitted to the 1st MBBS in 2018, should only be considered. From this group number of students failed together in May-June 2019 (Regular Batch) and September-October 2019 (Supplementary Batch) in 1st MBBS University Examination should only be considered as 'Clear Vacancy'. If more than 5% of candidates of the total intake capacity are failed then the vacancy will remain maximum up to 5% only. If the result of the institution is 100% then the Clear Vacancy will remain 'Zero'.

7. The vacancy will be determined as per the clarification received from the Medical Council of India vide its letter No. MCI-31(1) (Gen)/2009- Med/6568, dated 5.5.2009 i.e. "vacancy in any batch, in any medical colleges for the purpose of migration is that number which when filled after migration shall not result in an increase in the sanctioned intake capacity for the academic year concerned in respect of that medical college".

The availability of clear vacancy against which the transferor the migration is to be effected and the clear vacancy shall mean,

I. vacancy arising out of less number of admissions than the annual intake capacity for the first-year course;

II. vacancy arising out of the migration of student, after passing the first year examination;

III. a vacancy arising due to number of drop-outs during the same academic year;

IV. a vacancy arising after deducting the number of failures out of regular examinees of the first professional examination.

In no case, the college should exceed total intake capacity.

8. There shall be no transfer on any ground from one recognized Medical College to another recognized Medical College within the same City.

9. The transfer application fee shall be 10,000/- Payable to Director of Medical Education & Research, Mumbai. Application accompanied with the demand draft in favor of 'Director of Medical Education & Research, Mumbai', payable at Mumbai from any Scheduled Commercial Bank shall be received by the Director, Medical Education, and Research, Mumbai on or before the last date as notified. This fee shall be nonrefundable. After the last date of submission of application, 2 working days period will be given for the late submission of the application. However, during this 2 days period, the applicant has to pay application fee Rs. 10,000/- plus late fee Rs. 10,000/- total one D.D. of Rs. 20,000/-. In no case after this date application will be accepted.

10. The application is to be submitted in person on a working day within the notified time limit, at the CET CELL of DMER. The application sent by post/courier will not be entertained. The application should be submitted in CET CELL of DMER only. Application submitted in the Inward Section of DMER office will be treated as INVALID.

11. The applications for transfer shall thereafter be placed before a transfer committee constituted as per Government Resolution No. MED1009/CR-96/Shikshan-2, dated 4th April 2009 for this purpose.

12. The fee structure and service bond conditions of the receiving colleges shall be applicable to the transferred student.

Procedure for Transfer :

(a) The transfer shall be considered on the following genuine ground.

(i) Death of Father/Mother or supporting guardian, as declared at the time of admission, will be considered as genuine ground. However to be eligible under this ground the death of Father/Mother or supporting guardian should have been occurred after taking

admission to the 1st MBBS course. The candidate should attach a copy of the Death Certificate with his/her application form.

(ii) Illness of candidate causing permanent disability shall be considered as genuine ground. To be eligible under this ground, the candidate should submit illness/medical certificate stating that the illness has caused Permanent Disability of 40% or above. The specified disability should be as permitted in the schedule provided in Clause (Zc) of Section 2 of the Rights of Persons with Disabilities Act, 2016. The Percentage of disability should be calculated as notified by the Gazette Notification issued by Government of India, dated 04.01.2018. The disability should have occurred on the date of or after 1st-year MBBS admission. (in Annexure-E).

(iii) The illness/ disability of any other family member will not be accepted as a ground for transfer.

Procedure for Obtaining Medical Certificate:

i. The candidate seeking transfer after 1st-year MBBS on Medical/Health ground should submit medical certificate issued by

Special Referral Medical Board(s) as which have been authorized for issuing disability certificate for 1st-year admission to MBBS course (Grant Government Medical College & Sir J J Hospital, Mumbai or All India Institute of Physical Medicine and Rehabilitation, Mumbai) Medical Certificate should mention that illness of candidate causing permanent disability of 40% or above.

ii. Candidates should approach the Dean/Chairman of the Special Referral Medical Board(s) well in advance. Applications without medical certificates will not be accepted. The late issue of medical certificate by the medical board will not be accepted as a reason for the extension of the last date.

iii. The Special Referral Medical Board should handover the medical certificate directly to the candidate and one set of medical certificate should be submitted to the DMER office. The candidate should attach a medical certificate along with the application form. The candidate submitting two medical certificates i.e. Annexure E1 and E2 will be held ineligible for transfer.

(b) The candidate who has passed the 1st MBBS University examination before May/ June 2019 should not apply along with this 2019 batch, as they are not eligible as per the Medical Council of India guidelines for the transfer.

(c) The seats reserved for candidates belonging to the reserved category shall be 50% of admissible seats.

(d) The candidate can apply for transfer to a maximum 5 (five) receiving medical colleges.

(d) The manner of filling the seats reserved for Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes and Other Backward Classes shall be filled in as per procedure laid down vide Government Order No. MED 2006/1196/CR-204/06/ Edu-1.- 24th June 2006. The candidate belonging to Maharashtra State (Domicile) will only be considered under Reserved Category. Reserved Category candidate from Outside Maharashtra will only be considered as an Open Category candidate for transfer.

Procedure for selection

(a) Amongst the eligible applicants, two separate lists will be prepared, first List-A of candidates applying for transfer on the ground of death of one of the parent or supporting guardian, then List-B of candidates applying for transfer on health ground. In List-A, all eligible candidates will be arranged as per the CET merit. After exhausting List-A, if seats remain vacant, the List-B will be operated. In List-B candidates will be arranged as per the CET-merit.

(b) Candidates from State Government/Corporation Medical Colleges will only be considered for transfer to another State Government/Corporation Medical Colleges.

(c) Candidate from Private /Deemed University Medical Colleges will only be considered for transfer to another Private /Deemed University Medical Colleges.

(d) Candidate from Private Unaided/Deemed University Medical College will not be considered for transfer to Government/Corporation Medical Colleges.

(e) For private/deemed university applicant two separate lists (list A, list B) will be prepared as per clause 14(a). After exhausting list (A), if seats remain vacant then list (B) will be operated.

15. Criteria for preparation of merit list

(a) For applicant from Government/corporation Medical colleges - While preparing the merit list of All India Rank in NEET UG will be considered.

(b) For applicants from private Medical Colleges/Deemed University Medical Colleges. Separate merit list will be prepared on basis of NEET-UG All India Rank.

(c) For applicant from Government of India (GOI) nominee, NEET UG

All India Rank will be considered for deciding the merit.

16. Tie Breaker

If candidate from equal percentile in two different years of NEET-UG, then,

(a) Candidate with a higher percentage of marks in HSC/12th Std. will be preferred. If tie persist -

(b) Then the student with higher total marks in 1st MBBS examination excluding grace marks if any shall be given preference. If tie persist -

(c) Then the older student shall be given preference.

17. If the migration is sought from one recognized Medical College to another recognized medical college located outside the state, the matter will be referred to the Medical Council of India, New Delhi.

18. A student who has joined another college on transfer shall be eligible to appear in the 2nd professional MBBS examination only after attaining the minimum attendance in that college in the subjects, lectures, seminars etc. required for appearing in the examination prescribed under Regulation of Medical Council of India / Maharashtra University of Health Sciences, Nashik.

19. The College/Institution shall send intimation to the Medical Council of India about the number of students admitted by them on transfer within one month of their joining.

20. Any issue not dealt herein above will be dealt with, when arising, fully and finally by the Director, Medical Education, and Research, Mumbai.

21. The seat position for transfer in receiving medical college (General / Reserve Category) will be made available on the DMER's website immediately after the 1st MBBS result of marks.

22. The application should be submitted in CET CELL of DMER only. Application submitted in the Inward Section of DMER office will be treated as INVALID.
