Sarvepalli Radhakrishnan University Medical College admissions cancelled, students to be shifted: SC

New Delhi: The Supreme Court of India has in a directive to the Sarvepalli Radhakrishnan University Medical College in Madhya Pradesh ordered the cancellation of its student admissions in the face of the inspection conducted by the Medical Council of India- revealing deficiencies. The driving reason behind the Supreme Court 's cancellation of admissions also happens to be the revelation made in the MCI report on the college depicting fake patients., who the report states were not patients, but were merely been shown lying on the beds, as proof of occupancy.


A bench of Justice SA Bobde and Justice L Nageswara Rao also gave directions that students whose admissions are cancelled be accommodated in other colleges of the state of Madhya Pradesh, in accordance with their merit.


The bench also issued a notice to the college asking why an order for compensation not be made by the court for students whose admissions have been cancelled and who have been made to sit in a deficient college for no fault of theirs.


Despite the counsel of the petitioner disputing the MCI report allegations ,the bench observed: “In any case, this Court hereby accepts the inspection since we are not inclined to go into the disputes on facts raised on behalf of the petitioner-college... we are satisfied that the petitioner-college has failed in the said inspection.”...


On this aspect of the fake patient, the bench said: “We find that we are not in a position to determine the truth or otherwise of the allegations. However, if the allegations of the MCI are correct, it is obvious that a serious offence as contemplated by Section 193 of ... the Indian Penal Code may have been made out.”


The court also directed that a committee headed by a senior officer deputed by the CBI Director and two doctors of the All-India Institute of Medical Sciences (AIIMS) be constituted to inquire into these aspects.The court has also asked for a report of the committee to be submitted before it within three months.
