Petition in Gujrat HC challenging Medical Admission Rules

Gujarat HC has directed the state government to submit an affidavit in response to petition filed by 15 students. These 15 students filed a plea, against rules allowing CBSE students from previous years, seeking medical admissions this year. The rules allow CBSE students to seek medical admissions without their marks being cut. The 15 students are reported to be objecting to these rules.

They have challenged Rule 11(A) (1) (b) of the Gujarat Professional Medical Educational Courses (Regulation of Admission in Undergraduate Courses) Rules, 2016, which allows such students to seek admission by taking GujCET afresh, said their counsel Dhaval Dave to the media.

The 15 group students are seeking cancelling of the rule on the ground of it being arbitrary, discriminatory and also violating provision of the constitution. They are urging the court for restraining the Admission Committee for Professional Courses (ACPC) from admitting candidates on the basis of this rule; the ones who passed the 12^th standard exam before 2015-16.

The petitioner students have also substantiated their stand by submitting that such a rule is unjustified in treating students, who have passed class 12^th standard in 2015-16 and previous years-equivalent to students taking admission in academic year 2016-17.

The petitioner students have also shared their anguish over the fact that these students also have an advantage of attempting GUJCET many times. By now scaling down their marks, it seems being totally unfair to other students.

Contrarily, students from 2015-16 will have a challenging time, as from next year they will be required to appear for NEET to seek medical admissions. So, losing an year will cost them much more. Hearing in the court is scheduled for next week.

As reported by MD team recently, the overall cut off marks on the medical admissions merit list this year may be 2 % higher than in 2015, believe Admission Committee officials. This being the result of the numbers of performing students in the state doubling. With at least 337 students more than in last year having scored in the top 4% bracket in GujCET, and with the prospect of a further 10% seats going to EBC quota candidates, officials believe that in the coveted BJ Medical College, the cut-off marks are not likely to drop below 96%.
