Petition alleges AIIMS not giving disabled rightful quota in PG Medical Seats, Court seeks response

New Delhi: Responding to a petition that All India Institute of Medical Sciences is not giving the rightful reservation of 5% to persons with disabilities (PWD) in its postgraduate seats , the Delhi HC has sent notices to the ministries of social justice and health as well as AIIMS to file a response in the plea.


Rights of Persons with Disabilities Act, in higher education institutes have to reserve five percent of their seats for disabled candidates.

Prahari Sahyog Association in their petition alleged that the AIIMS is legally bound to provide five per cent seats out of the total 435 for the post-graduation (21 seats) to people with disability but had only provided one seat to them.

The Delhi High Court, responding to their plea, sought a response from All India Institute of Medical Sciences (AIIMS) as the petition seeks inclusive education for people with disability and asked the institution about the steps taken to provide five per cent reservation. It also sought responses from the ministries of social justice and health and family welfare on the matter


Advocate Gaurav Kumar Bansal, representing the association, told the court that by not adopting "principle of inclusive education" as well as not providing reservation, AIIMS is doing discrimination with the "brilliant minds having a disability".

The division bench headed by Chief Justice D N Patel has asked the institution to reply within four weeks.

With the admission process for MD, MS, DM (6yrs), MCh (6yrs) and MDS for January 2020 session going on, the All India Institute of Medical Sciences (AIIMS) has released the final seat position for the courses. As per the final seat matrix released by the AIIMS, there are a total of 546 MD, MS, DM(6yrs), MCh(6yrs) and MDS seats up for grabs for the candidates.
