No fault of KNURHS : HC gives nod to resume MBBS Counselling

Hyderabad: The Telangana High Court has vacated the stay on the MBBS and BDS admissions while dismissing the petitions which questioned the counselling process conducted by the Kaloji Narayana Rao University of Health Sciences (KNRUHS).During the hearing, the high court bench however observed that the university could not be faulted for the manner in which it undertook Phase II counselling.


Subsequently, the KNRUHS has issued a notification informing about the commencement of the final phase of MBBS, BDS counselling.


On August 8, the HC had stayed the Round 2 counselling of 50% convenor quota considering a plea alleging malpractice in the admission process and violation of the Government Order (GO) 550 and 114.


While AP brought the GO 550 in 2001, Telangana brought a similar order in the form of GO 114 in 2017.


On July 30, 2001, the then government issued GO RT 550 on seat allotment in professional courses. The government order stated that the open category seats are to be filled first on the basis of merit irrespective of the reservation category. It’s only after the open category seats were allocated were the reserved seats to be considered.


The order also clarified that if a reserved category candidate was allotted an open category merit seat and left the reserved seat for better opportunities, the vacancy generated was to be filled by a candidate from the same reserved category on merit basis.


The High Court and the Supreme Court had upheld these GOs as several petitions were filed, challenging their validity. Hence, the admissions were directed to be done as per the GO 550.


The petitioner students, while accusing the varsity authorities of doing injustice to students of reserved categories; had moved the high court seeking an order to declare the admissions made in Round 2 illegal. They claimed that the university officials failed to adhere to GO 550.

During the recent hearing, the high court bench observed that the university could not be faulted for the manner in which it undertook Phase II counselling.


The bench took note of the counsel who presented contentions on behalf of the varsity. The counsel had submitted that GOs can be implemented in the first phase only and cannot be implemented in the subsequent stages of counseling.


If the meritorious reserved candidate (MRC) slides only once, then there is no problem. But if he keeps on sliding, then it becomes a problem. The authorities have to wait for the correct picture of vacant seats to emerge and then if they again implement GOs here, that will lead to a stage where reserved seats will cross the statutory 50 percent.


TOI reports that the bench studied the material before it and said that KNRUHS officials have been implementing their GO 114 correctly and they did no injustice to any reserved candidate so far.




“the authorities had not done anything that would adversely affect the chances of the students of the reserved categories.”



TNIE, in its report, quotes the court as saying;




“Having perused the statistics, we find that no injustice was done to reservation category candidates. We, therefore, find no merit in the petitioners’ contention that in the second Phase counselling, open category non-joining seats had to be dealt with in the same manner as open category seats were dealt with in the first phase counselling,”



In its decision, the HC vacated the stay it imposed on further admissions and asked the authorities to complete the remaining sessions of counseling; and told the KNRUHS officials that they need not refer to GO 550 anymore.


In compliance, KNRUHS has activated the link for candidates to exercise web options for the final phase of counselling. The notification to this effect mentions that candidates with 1st to Last rank including NCC, CAP and EWS quota category can exercise their web options by 22nd August 2019.




  • All the candidates in the final merit list displayed on KNR UHS, web-site on 16-07-2019 are eligible to exercise web-options subject to fulfillment of following conditions. Candidates whose names are displayed in CAP and NCC Merit lists are also informed to exercise web options. Candidates who have been shown as being eligible for EWS quota in the final merit list are also informed to exercise web options. Candidates who have secured admission in the previous phases of counseling and joined the course and continuing in the course, who wish to slide to other college / course also can exercise their options.

  • The candidates who have been allotted seats in the second phase of counseling and who have not joined / discontinued the course after joining are not eligible to exercise options for final Phase of counseling. Candidates who have joined the course in All India Quota / Deemed Universities Counseling are not eligible to exercise options for Final Phase of counseling as per the orders of Hon'ble Supreme Court and Medical Counseling Committee (MCC) of Government of India. Candidates who have joined MBBS Course in colleges under Dr.NTRUHS, Vijayawada are informed not to exercise web options, as the MBBS course admitted candidates under Dr.NTRUHS are not permitted to discontinue the course after 17.8.19 as per notification issued by Dr.NTRUHS.

  • Allotment of seats will be done as per the procedure following G.O.Ms.No.114 HM&FW(C1) Dept. Dated:05-07-2017 and other Government regulations and Hon’ble High Court orders in WP No.16637 of 2019. Candidates are informed that the allotments are also subject to final orders in all pending writ petitions in respective courts.


UNIVERSITY FEE:


Rs. 10,000/- for both MBBS and BDS Courses have to be paid for obtaining allotment letter through payment Gateway by using Online payment method. (Debit Card/Credit Card/Internet Banking).


TUITION FEE:


As per existing Government guidelines for Govt. / Pvt. (Minority/ Non-Minority) Medical & Dental Colleges and Army Dental College.




  • List of seats vacant due to non joining of candidates after second phase of counseling is displayed on KNRUHS web-site. Vacancies of reverted All India Quota seats will also are displayed in seat matrix separately . Seat matrix for Seats sanctioned for implementation of EWS quota also is displayed on website separately . Candidates while giving options should note that apart from vacant seats, seats vacated by candidates sliding during this phase of counseling will be added and allotted simultaneously during this phase of counseling. The allotted seat under second phase counseling will be cancelled automatically if the candidate is allotted a seat in final phase of counseling as per his/her option.
