MCI relief to Candidates with locomotor disabilities: MCC issues notice for amendments

New Delhi: Through a recent notification Medical Counselling Committee (MCC) informed about the PwD candidates regarding Guidelines for admission of students with "Specified Disabilities" under the Rights of Persons with Disabilities Act, 2016.

The MCC confirmed that the Board of Governors in Supersession of Medical Council of India has issued revised Guidelines regarding admission of students with “Specified Disabilities” under the Rights of Persons with Disabilities Act, 2016 on March 11, 2019. With the amended guidelines PwD candidates who were earlier found ineligible, because their Locomotor Disability was >90% will get a respite. MCC noted that such candidates should get themselves reassessed in the light of above directions from any of the designated Disability centres and obtain a fresh Disability certificate to avail the benefit of 5% PwD reservation.

This is in continuation to the earlier Notice for PwD candidates regarding Guidelines for admission of students with "Specified Disabilities" under the Rights of Persons with Disabilities Act, 2016 vide Gazette Notification No. MCI-34(41)/2018-Med./170045 dated 5^th February, 2019, an Amendment has been issued by the Board of Governors in supersession of MCI, vide letter No. MCI­18(1)2018/2018-Med/186891 dated 11.03.2019 in the Post Graduate Medical Education Regulation, 2000 for upper limit of locomotor disabilities. However, the said disability criteria had met with stern opposition by candidates.A s per the said MCI notification,

Divyangs (especially challenged) with more than 80 per cent disability have been barred from pursuing MBBS education. In addition, aspirants having, Dysgraphia had also been prohibited to take up the profession.

Challenging the MCI notification, many petitions had also been filed with the court. Last week, the MCI BOG had filed in the court, that the MCI notification specifying the eligibility criteria of PwD (Persons with Disabilities) candidates who want to pursue medical courses, on the basis of their disability; is once again being amended

The information to this effect surfaced in a response given by the MCI on the petition filed against the said notification in the Delhi High Court recently. The recent plea filed by one, Dr Mohd Shaloo, having a benchmark disability of 90 per cent, challenged the February 4 notification which made him ineligible to study medical course (NEET PG 2019). The plea sought setting aside of the government notification
