Madras HC orders Action on Engineering, BDS students now pursuing MBBS

Chennai: A notice has been issued to the authorities by the Madras High Court based on appeals made by two MBBS course aspirants seeking a seat allotment each in medical colleges. The court said that their admissions would be, however, based on the outcome of the writ filed.


The appeal of the two petitioners Gayathri Swaminath and Kannan alias Sivakumar, a native of Puducherry, revealed that they had obtained admissions in a BDS and an engineering course, respectively, under the government quota.


While Gayathri took on the BDS course in 2015-16 Kannan got admission into an engineering college in 2012-13. They together sat for Neet 2017 and cleared it as well.


However, when they sought admission into the MBBS course, they were denied entry on the basis of two 2015 government orders. In accordance with these orders, since they had earlier taken admission under the government quota, in a professional course, the authorities had refrained from giving them admission to the MBBS course, stated their counsel M. Ravi.


The division bench comprising Justices Rajiv Shakdher and Abdul Quddhose, however, passed interim orders when the matter came up for hearing in their court.


The bench observed admission had been denied to them on the ground of having availed admission under the government quota on earlier occasions in BDS course and engineering course as well. Thereby, not being entitled to admission in MBBS course.


When the bench asked the Medical Council of India (MCI) to clarify on the issue, its senior replied, “no such restriction has been imposed by MCI”, reports the Deccan Chronicle.


The bench ordering notices returnable in two weeks said the matter required serious examination. Till then, the earlier interim orders directing medical colleges to keep seats vacant for the two was to hold good, the bench said.


The duo will be granted admission subject to the writ outcome.
