Follow Rules of Domicile Quota Admissions: MP High Court tells DMER

The Madhya Pradesh High Court in an interim direction has directed the medical education authorities to ensure 50% seats are reserved for domicile students of Madhya Pradesh in private medical colleges. This is to be done as per norms of MP Autonomous Medical and Dental Post Graduate Colleges Admission Rules 2017. Notices were served by the court on the respondents, including the Director of Medical Education and five private colleges during the course of a hearing for a petition filed by a lady doctor.


The petitioning doctor challenged admissions of certain students by the Medical education authorities which went contrary to the domicile norms of MP Government Autonomous and Medical and Dental Colleges Post Graduate Course (Degree/Diploma) Admission Rules, 2017.


The petitioner cited that admissions given to students on seats reserved for domicile students were from outside the state and did not possess a domicile certificate, a mandatory condition for eligibility under Rule 6(II) of the MP Autonomous Medical and Dental College Post Graduate Course (Degree/Diploma) Admission Rules.


A division bench comprising of Justice Sushil Kumar Palo and Justice Ravi Shankar Jha directed “the respondent/authorities shall ensure that the 50% seats reserved in Private Medical Colleges for students of M.P. or reserved for M.P. students in private medical colleges shall be filled up by only those students who fulfill the eligibility criteria and qualification regarding domicile prescribed under the provisions of the MP Autonomous Medical and Dental Post Graduate Colleges Admission Rules 2017
