Gujrat HC directs non domicile students to be granted MBBS admission

Ahmedabad: The Admission Committee for Professional Undergraduate Medical Courses has been ordered by the Gujarat High Court to accept students applications if they qualify for admissions, even if they have not passed their Class X exams from a Gujarat school or they have not been domiciled in Gujarat.

The Gujarat High Court in this matter earlier issued a notice to the state government on a petition of students challenging a rule making it mandatory to pass both Class 10 and Class 12 from schools in the state to qualify for admission to medical courses there.

The division bench of Chief Justice R Subhash Reddy and Justice V M Pancholi also granted interim relief to students in 2017 who were found ineligible for admission because of the new rule and asked the government to consider them as eligible candidates.

Earlier, the rule required students to pass Class 12 from a school in Gujarat to qualify for admissions. By virtue of the amended rule 4(3), students who have not passed 10th standard examination from schools in Gujarat became ineligible for admission to various medical courses in colleges in the state, the petition said.

The student writ also challenged the state recent decision to not grant admission to students in medical courses under state’s quota if they did not enjoy the domicile of Gujarat.

It has been made mandatory by the state authorities that students have to be pass outs from Gujarat for their class X and XII examinations, besides enjoying a state domicile in order to be eligible for admission to undergraduate medical courses reports TOI.

The students claimed that the Gujarat Government’s criteria are unreasonable and arbitrary as they severely restrict opportunities for students who have passed the class X exams from outside the state and cleared class XII from Gujarat.

Furthermore, the decision they said was discriminatory against students who cleared their class X and XII both from Gujarat but did not have the state domicile.
