HC relief to Final Year MBBS student: Stay on Arrest Order

It has been alleged that the MBBS student availed the scholarship via forged income certificate with the help of revenue officials and some officials of the Department of Social Welfare.


Nainital: A final year, MBBS student, who is accused of submitting fake income certificate to avail scholarship to fund the UG medical course; has been granted interim relief by the Uttarakhand High Court.


According to recent media accounts, the court has granted a stay for one-week on the arrest of the accused MBBS student. The court has additionally directed the state government and the petitioner to file their reply within the stipulated time frame.


The accused final year MBBS student allegedly forged income certificate to finance his MBBS course in Himalayan Institute of Medical Sciences. The breach came to light during the investigation conducted by State Income Tax (SIT) Department after an FIR was registered by Haldwani-based advocate alleging scam worth lakhs of rupees and accusing several officials at Department of Social Welfare for the same.

The MBBS student's father works in the same department, as a District Social Welfare Officer. He along with other government officials have been accused of fraud by the complainant.


During the course of the investigation, the SIT found that the MBBS student availed scholarship from the Department of Social Welfare as a fee reimbursement for the MBBS course. It has been mentioned in the report by the local daily Jagran that the student availed the scholarship via forged income certificate with the help of revenue officials and some officials of the Department of Social Welfare.


News18 adds that in those fake income certificates, the accused MBBS student showed his father's income of 3500, 5000 and 6500 rupees, while his father's salary is more than four lakh per annum.

On the orders of SIT, a case was registered under sections 420 (cheating and dishonestly inducing delivery of property), 467 (forgery of valuable security, will, etc) 468 (forgery for purpose of cheating) 471 (using as genuine a forged (document or electronic record) and 120b (criminal conspiracy) of Indian Penal Code, reports TOI.


Further, challenging the SIT's order directing his arrest, the accused student moved the state HC, which has now put a stay on his arrest and directed the state and involved parties to submit their side on the case.


This issue of the forged income tax certificate, in a bid to avail scholarship at educational institutes, is alleged to be a much larger multi-crore scam.
