Common Counselling: Karnataka HC refuses to recall its May 30 interim order

The Karnataka High Court has refused to recall its May 30th, 2017 interim order giving a directive for admission to vacant seats through the Common Counseling Authority(KEA) as provided under Regulation 9A of the Postgraduate Medical Education Regulations, 2000.


Disallowing the intermediary application filed by the state government, a Justice HG Ramesh headed division bench stated, that regulation 9A has no application to Post graduate dental courses.


"We have gone through the decisions and the orders of the Supreme Court referred to by the Advocate General. Nowhere it is stated that vacant Postgraduate medical seats in Karnataka may be filled without following Regulation 9A of the Regulations. In the May 30 order, all this court said was to follow the law laid down by a 7-Judge Bench of the Supreme Court in P.A.Inamdar case with regard to 'NRI quota' and to follow regulation 9A in the matter of admissions to Postgraduate medical courses in Karnataka. No exception is provided to Regulation 9A in the Regulations" the bench has observed reported TOI.
