AP: Prez order does not applicable to mgmt quota seats

Hyderabad: A division bench of Hyderabad, in no uncertain terms made it clear that the Presidential Order arising out of article 371-D of the Constitution of India giving reservation to candidates of educational institutions in Andhra Pradesh and Telangana is not applicable for B category management quota seats in private medical colleges offering medical and dental courses.


The bench also put aside all arguments put forward by the petitioners, challenging the decision of the Association of Private Medical Managements of both the states. The association made a declaration that category B seats of management quota, of private medical colleges, were to be filled through the NEET ranking and students from all over India could apply.


The petitioners argued still further saying that the seats should be the exclusive right of students from AP and Telengana as per the presidential order issued under Article 371-D. The bench in turn asked the state governments of Telangana and AP to respond. The two state governments on their part made it explicitly clear that the presidential order was not applicable to Category B seats of the management quota, of private medical colleges


The bench after hearing the government's stand pointed out that the presidential order pertains to institutions under state government control and private medical colleges did not fall in this category.


The bench also pointed out that after the judgments of the Supreme Court, a change had come about in the principles governing medical education and rejected the petitions.


The order was dictated in open court and the final copy is yet to be made available.
