    NEET not mandatory for BUMS: Bihar High Court

    Patna: The AYUSH ministry's order - making National Eligibly cum Entrance Test (NEET) compulsory for taking admission in Bachelor of Unani Medicine and Surgery (BUMS) course has been recently set aside by the Patna high court.

    The order came after the court observed that the council regulations had to be amended in order to make NEET mandatory and it could not have been done by an executive order by the ministry.

    It is reported that the Ministry had issued a letter in February 2018 through which it allowed the AYUSH colleges to take admission to for various courses, including BUMS only available to the NEET qualified students.

    The Ministry of AYUSH in its official notification announced that in the process of streamlining the admissions and to bring meritorious students to the AYUSH systems of medicine in the country, the Ministry had requested all the State Governments to admit students in AYUSH Under Graduate Courses from the academic year 2018-19 through the merit list of National Eligibility cum Entrance Test (NEET) only.

    Therefore come Academic Year 2018-­19, all UG seats of AYUSH Degrees namely, BAMS, BHMS, BUMS, BSMS and BNYS shall be filled by considering the merit list of National Eligibility cum Entrance Test (NEET) only.

    The implementation of the said order became peculiar in Bihar as the state government issued the order to this effect on March 23rd, 2018; long after the last day of submission of the NEET application form -March 9. On that basis, Bihar Private Unani Medical Colleges challenged order given by the ministry at the Patna high court.

    A petition was drafted which made a point against the ministry stating that the AYUSH Ministry had made NEET compulsory through its notification whereas Central Council for Indian Medicine, the regulatory body, had not make NEET mandatory.

    The court agreed with the petitioner that the council regulations had to be amended in order to make NEET mandatory and it could not have been done by an executive order by the ministry.

    The court asked the central government to reply on the issue that can NEET be made mandatory for taking admission in BUMS without the amendments made by the regulatory body for which center failed to satisfy the court, reports TOI.
