MP HC quashes 150 MBBS students allotment in Private Medical Colleges

Bhopal: After finding large-scale illegalities, the Madhya Pradesh high court canceled 150 MBBS seat allotment made by the Department of Medical Education (DME) in the various private medical colleges.

The action comes after the court heard a petition filed by the LN Medical College seeking an appropriate order quashing the allotment list.

Last year, after the RKDF medical college was found unable to live up to the Medical Council of India (MCI) norms, so, the SC halted the counseling for medical colleges in the state by issuing directives to the Madhya Pradesh DME to adjust these 150 MBBS students from the private medical college of the state.

In response, the department complied with the directions of the apex Court. However, when the medical colleges viewed the allotment list, some irregularities were noted.

In reference of the same, the LN Medical College filed the petition submitting, “there may not be a separate counseling for allotment of the colleges to 150 students but the admission ought to be given on 25 seats of each college out of 150 students on the seat of their particular category merit-wise and as per option given by them otherwise the net result would be 150 students, who have been distributed in the various 5 medical colleges, shall get admission not against the seat of that category, which would again create a cause and a heart burning to the other students opening further litigation to those students, who belong to other category but by the said list, admission was given against the seat of different category although it is not the purpose of the directions of Hon’ble the Supreme Court.”

The petitioner college sought cancellation the list and the subsequent admission of the students in equal number in the six private medical colleges.

During a recent hearing, the court found major illegalities in the allotment. According to a report by the Free Press Journal, the illegalities that were alleged included:

• Majority of General category students amongst the 150 being allotted to:

1. Aurobindo Medical College


2. RD Gardi Medical College


3. Chirayu Medical College

• 90 percent reserved category students being allotted to the remaining colleges:

1. LN Medical College


2. Index Medical College

Because of this alleged foul play by the authorities concerned, the aggrieved colleges were left only with reserved category students to be taught, the daily added.

In its conclusion, the state high court quashed the allotment list and directed the state government for carrying out the entire exercise of “ Fresh allotment and counseling” within 2 days of its order amongst the 150 students by following reservation roster as provided under the MBBS Admission Rules, 2018.
