MBBS admissions using fraud nativity certificates would automatically stand Invalid: Court Warning

Chennai: The Madras High Court has warned that medical degrees of candidates, who secure admissions in Tamil Nadu on the basis of fraudulently obtained nativity certificates, would automatically stand as invalid.

Any allotment granted to such students shall stand automatically cancelled without an order being passed by the authorities and if a candidate goes on to complete the course, the degree would stand invalid, Justice S Vaidyanathan said in his order yesterday.

The judge was dismissing a plea moved by a woman from Gujarat, seeking admission to a medical course in Tamil Nadu, after it was stated by the government that she had applied for the same course in her home state also.
The judge said students like the petitioner might fraudulently obtain an interim order and complete the course, assuming that the court would not take any action against them later since they had completed the course.

This would give a wrong signal, more particularly when the court was taken for a ride and genuine students were deprived of the seat, the judge added.

The petitioner had approached the court, seeking its direction to the Tamil Nadu selection committee for MBBS/BDS courses to give her admission on the basis of her nativity certificate of Chennai.

She had claimed that she had applied for the course only in Tamil Nadu and not in any other state.

When the plea came up for hearing, Additional Advocate General C Manishankar informed the court that the petitioner had already applied for the same course in Gujarat as well.

There was a clear prohibition against such applicants in the prospectus of Tamil Nadu, he added.

Noting that it was unfortunate that the petitioner had come before the court with a false statement, Justice Vaidyanathan said though strictures could be passed against her, she was being let off considering her tender age and that her future should not be ruined.
