Jammu: Selection List of dental Surgeons quashed by HC

Jammu: In response to a petition filed by petitioner Suksham Singh, the High court has taken the decision to quash the entire selection list of House surgeons in Dental College,Jammu.

The court’s decision came after the hearing where advocate Abhinav Sharma appearing for the petitioner, Deputy AG, PS Chandel appearing for the State, whereas Senior Advocate DC Raina with Advocate Anuj Dewan appearing for the 20 private respondents,.

Justice Dhiraj Singh Thakur after hearing Advocate Abhinav Sharma appearing for the petitioner, Suksham Johar, observed that the entire selection and appointment would have a rippling effect as all the candidates would be affected by it.

Fearing anomalies in results if not cancelled in its entirety it was decided by the court that all of it would have to be cancelled which meant selections made by the Principal Indra Dental College, Jammu.
‘As it was contrary to the to the advertisement notification dated 20.5.2016 and the Govt. Orders reflected therein and accordingly it is quashed
,’ observed Justice Dhiraj Singh Thakur.

Justice Thakur gave a directive that a fresh list be drawn by official respondents on the basis of merit and discipline He ordered that the respondents based upon merit, invite the preferences in each discipline from the candidates. This he said could be done through counselling open to official respondents. He further made clear that an assist could be sought from the SSRB or Public Service Commission for purposes of conducting the selection and
counselling process
and also seek their advice on those issues.

However, the final decision would be taken by the official respondents themselves. The entire process is to be completed preferably within a period of two weeks from today, Justice DS Thakur directed.

Looking at the fact that the petitioner has been dragged into this litigation unnecessarily, a cost of Rs. 25,000/- is to be released in her favour, which shall be paid within two weeks, the court further directed , while quashing the list.
