HC slams Navodaya Medical College, threatens shutdown over Capitation fee

Bengaluru: Navodaya Medical College, Raichur, was given a dressing down by the Karnataka High Court, recently, for keeping one of its an MBBS student from sitting for his exam as he had not paid the remaining capitation fee. Coming down severely the court questioned as to why an irregularity of this nature not be punished with the closure of the college.


The bench comprising of Justice Vineet Kothari made the observation while hearing a petition filed by Dr Ganesh B, a resident of Rajarajeshwari Nagar, Bengaluru.


Dr Ganesh, a final-year MBBS student in the college, was disallowed permission to appear for the final-year diploma exam as he had not paid the remaining part of the capitation fee.


As per his complaint, Dr. Ganesh a two-year diploma (orthopedics) student of the college had to write the final year exam next month but the having been denied permission challenged the college in the court of law.His petition stated that the college asked him to pay Rs 60 lakh as capitation fee during admission. However since he was able to pay a mere twenty lakh payment, the college refrained from giving exam permission.


Justice Kothari expressed his displeasure at the capitation fee act of the college.He observed: "You are running a medical college under the name of a trust and there were allegations of a lot of irregularities and tax evasion," reported the Deccan Herald


He directed the college principal to submit a detailed report on student strength in each department, number of seats and amount of fee collected from students. He gave directions that the college submits its account details for the last 3 years.at the next hearing.


Justice Kothari asked the college to give Ganesh the permission to appear for the exams.


He further directed Rajiv Gandhi University of Health Sciences to file an affidavit regarding what action it deemed fit against the college for the irregular acts, directing that the MCI be made one of the respondents in the case


The case has been put up for further hearing for the 5th of June
